As to appear on booth sign & show directory
Neither Market Square, Inc. d/b/a “The Gallery”, nor any of its officers, employees and other representatives, shall be held accountable or liable for, and the same are hereby released from, accountability or liability for any damage, loss, harm or injury to the person or any property of the applicant or any of its officers, agents, employees or other representatives, resulting from theft, fire, water, accident or any other cause. In route to, at the show site or surrounding grounds.
IMPORTANT NOTICE: The applicant hereby agrees to indemnify, defend, protect and hold harmless Market Square, Inc, its officers, employees, agents and the Property Owner, against any and all claims, demands, suits, liability, damages, loss, costs, attorney fees, and expenses of whatever kind or nature which might form or arise out of any action or failure to act of the applicant, or any of its officers, agents, employees, invitees or other representatives. This duty to defend and indemnify arises from the first notice of claim and continues until resolution.
This duty is applicable even though Market Square, Inc. d/b/a “The Gallery” or the Property Owner are also found to be concurrently negligent.
If the Market premises be destroyed by fire or any other cause, whatever that makes it impossible to conduct Market Square, your contract will terminate and the exhibitor will waive any claim for damages or refunds.
I have fully read and understand all the rules and regulations on the reverse side of this contract and further agree to send 50% of the full amount for booth space with this contract. We understand if balance is not paid 45 days prior to the show, our agreement will be cancelled without refund, and show space will be assigned to another exhibitor.
